Polymarket odds on the Clarity Act being signed into law this year fell by roughly half overnight, sliding from around 30% to 34% on Monday to 17% to 18%.The drop followed news that Democrats crafted a counterproposal after rejecting a revised draft Republican negotiators circulated Sunday.Bitcoin gave back Monday's rally, falling 1.7% since midnight UTC to $76,862 after touching $79,427. A failure would not signal Senate opposition to splitting oversight between the SEC and CFTC. The premium measures US institutional demand against global flow, and a negative reading means US buyers are paying less rather than bidding up.Liu noted spot Bitcoin ETFs saw around $300 million of net outflows over five sessions before a $160 million inflow Monday.The Market Has Already Adjusted to Life Without the BillFxPro chief market analyst Alex Kuptsikevich made the observation that reframes the stakes.Total crypto market capitalisation sits at $2.65 trillion, roughly where it traded in May — when prediction markets gave the Clarity Act better than a 75% chance of passing this year."It appears the market is getting used to life without this legislation," Kuptsikevich said.The market touched $2.71 trillion Tuesday, matching last week's high, before sliding as Democrats tabled their counterproposal.Siebert Argues the Outcome Matters Less Than Traders AssumeBrian Vieten, senior research analyst at Siebert Financial, offered the dissenting view."We think the market is a bit too focused on whether Clarity passes," he said.A failure would leave US firms operating under the current SEC and CFTC approach, which Vieten said could pull product launches and tokenization work forward into 2027 and 2028 rather than shelving them.That cuts against the conventional reading, in which a failure shelves market structure legislation until after November's midterms.Positioning Is Balanced Into the VoteThe long-short taker-volume ratio in crypto futures remains finely balanced.Cumulative open interest fell 1% to $135 billion over 24 hours while trading volume surged 54% to $207 billion — existing participants closing positions faster than new ones open.Bitcoin's pullback to $77,000 was marked by taker selling in futures, according to Marex, with open interest hovering below 680,000 BTC and signalling weak demand for leveraged exposure.Open interest in ether, Solana and XRP futures also remains in a downtrend. Solana's recently stood at 58.81 million tokens, the lowest since May, per CoinGlass.Funding rates are moderately positive for most major tokens including Bitcoin.
