U.S. Senator Ron Wyden has sent a letter to Senate leadership urging them to retain the Blockchain Regulatory Certainty Act (BRCA) provisions approved by the Senate Banking Committee in the CLARITY Act.
According to Foresight News, crypto journalist Eleanor Terrett reported that the BRCA language would codify existing federal policy by clarifying that non-custodial software developers would not be treated as money transmitters solely for publishing software.
The provision would also preserve the authority of the U.S. Department of Justice and the Financial Crimes Enforcement Network to pursue entities that engage in illegal activity.
