CLARITY Act Proposes CFTC Oversight Amid Staffing Challenges

The CLARITY Act aims to assign oversight of the U.S. crypto spot market to the Commodity Futures Trading Commission (CFTC), despite a 21% reduction in the agency's staff to 556 over the past year. According to NS3.AI, the proposed legislation mandates that both the CFTC and the Securities and Exchange Commission (SEC) establish rules within 360 days of the bill's enactment. Additionally, the Title IV registration regime is set to be implemented in 270 days. Former CFTC officials have compared the anticipated workload to the extensive rulemaking required by the Dodd-Frank Act. However, the bill's provisions for additional funding will expire after four fiscal years.
