Trump Administration Proposal Could Exclude Undocumented Immigrants From 2030 Census Count

According to Axios, the Trump administration is proposing to exclude undocumented immigrants and other people without lawful permanent status from the 2030 U.S. census count, a move that could affect congressional apportionment and is expected to face legal challenges. The Census Bureau's draft rule says such people should no longer be counted because they are not "true inhabitants" or persons with a "usual residence" in the U.S. due to a lack of "allegiance." Axios reported that the proposal also would remove questions about race and ethnicity from the census and bar questions about sexual orientation, while leaving demographic questions on the American Community Survey in place. Pew Research Center found in 2020 that if unauthorized immigrants were removed from the apportionment count, California, Florida and Texas would each have lost a House seat. New York Attorney General Letitia James said she is exploring legal options to fight the proposal.
