▌SEC Enforcement Chief Calls for Stronger Crypto Regulation
SEC Enforcement Chief Gurbir S. Grewal discussed cryptocurrency regulation at a seminar at the William and Mary College of Business Law Review earlier this month. He stressed the need to enforce federal securities laws in the evolving cryptocurrency market. Grewal noted that the principled definition of securities in the 1946 Supreme Court case SEC v. Howey still applies to new investment schemes, including crypto assets.
SEC Enforcement Chief highlighted the significant investor losses caused by fraudulent crypto activity and stressed the urgent need to address these harms. He pointed to the numerous charges filed against issuers that conducted unregistered and deceptive offerings. Grewal emphasized that innovation and compliance with securities laws are not mutually exclusive, and that securities regulators are committed to working with cryptocurrency entrepreneurs to ensure compliance while promoting technological advancement. Finally, he stressed the need for strong enforcement to maintain public trust, protect investors and bolster confidence in financial markets by holding lawbreakers accountable and fostering a culture of compliance.

▌EBA publishes guidance on the ‘Travel Rule’
The European Banking Authority (EBA) has today published new guidance on the so-called ‘travel rule’, i.e. the information that should accompany transfers of funds and certain crypto-assets. The rule will help tackle the misuse of such transfers for money laundering and terrorist financing.
The guidance sets out what information should accompany transfers of funds or crypto-assets and sets out the steps that payment service providers (PSPs), intermediary PSPs (IPSPs), crypto-asset service providers (CASPs) and intermediary CASPs (ICASPs) should take to detect missing or incomplete information, and what they should do if a funds transfer or crypto-asset transfer lacks the required information.
The aim is to establish a consistent and effective way of implementing the travel rule across the EU, enabling the relevant authorities to fully trace such transfers, if necessary, to prevent, detect or investigate money laundering and terrorist financing.
