The U.S. Department of Labor’s final rule on including private equity, real estate, cryptocurrency, and other alternative assets in retirement plans such as 401(k)s was submitted to the White House Office of Information and Regulatory Affairs for review on Nov. 5, U.S. Eastern Time. According to Foresight News, the submission indicates the rule is nearing completion and is expected to be published soon. The department proposed the rule on March 30, offering plan fiduciaries a legal safe harbor for including private assets in 401(k) investment options if they consider six factors: performance, fees, liquidity, valuation, benchmarks, and complexity. U.S. President Donald Trump signed an executive order on Aug. 7, 2025, directing the department to reassess the relevant rules.
