Thailand SEC Proposes Derivatives Licenses for Digital Asset Operators Without New Companies

Thailand’s Securities and Exchange Commission is seeking public comment on draft rules that would let digital asset operators apply for derivatives business licenses without setting up new companies. According to Odaily, the SEC announced the consultation on October 29, proposing to recognize digital assets as eligible underlying assets under the Derivatives Act and revise rules covering derivatives exchanges, clearinghouses and intermediaries. Under the proposal, license holders could act as derivatives agents, trade on their own accounts, provide investment advice and manage investments. The license fee would be 500,000 baht, while existing digital asset exchanges, brokers and dealers would be exempt from application and license fees. Only digital asset exchanges and brokers could apply to operate derivatives exchanges; digital asset custodians could not apply for clearinghouse licenses.
