Polymarket odds on the Clarity Act being signed into law this year fell by roughly half overnight, sliding from around 30% to 34% on Monday to 17% to 18%.The drop followed news that Democrats crafted a counterproposal after rejecting a revised draft Republican negotiators circulated Sunday.Bitcoin gave back Monday's rally, falling 1.7% since midnight UTC to $76,862 after touching $79,427. Ether fell 1.6% to $2,474.76 and Solana lost 2% to $100.43.The Sticking Point Is Ethics, Not Market StructureThe provisions holding up the bill are not the ones the industry cares about.Negotiations have stalled over ethics language governing officials' crypto holdings rather than the market structure framework itself. Several Democrats who might otherwise vote for the bill said they had concerns about the revised ethics proposal. That distinction matters for reading the outcome. A failure would not signal Senate opposition to splitting oversight between the SEC and CFTC. It would signal an unresolved dispute over a provision adjacent to the bill's purpose.Senate Republicans released a revised 630-page draft folding in scores of Democratic provisions in an attempt to reach 60 votes. The Vote Decides Debate, Not PassageTuesday's 2:15 p.m. ET vote is procedural.Clearing cloture opens the bill for floor debate. To become law it must still pass the full Senate, and both chambers must reconcile and pass an identical version before it reaches the President's desk."CLARITY is still far from becoming law even with this, and if it stalls I'd expect the crypto equities to give back more than BTC, given again the beta," said Adam Morgan McCarthy, lead researcher at LO:TECH.McCarthy noted the vote requires approximately seven Democratic votes to reach the 60-vote threshold, with ethics provisions surrounding the president's personal crypto holdings unresolved. The count is the first hard number on how much Senate support the bill actually has.Fakhro: Failure Is Priced, Passage Is NotARP Digital partner Yusuf Fakhro identified the asymmetry."Downside from a failed vote is largely priced; a surprise passage is not," he said. That reading follows from the positioning. Funding rates have drifted toward zero, futures premiums have fallen below 5% and open interest has stalled.Thin leverage means no pile of forced sellers waiting to be liquidated. It also means nothing anchors price, so each headline pushes Bitcoin further than it should.Last week demonstrated the effect. Bitcoin ripped 5% to $81,000 Thursday on softer Fed signals, then gave the entire move back within hours when strong payrolls revived hike expectations.US Buyers Are Sitting on Their HandsCMC head of research Alice Liu pointed to the geographic split in demand."BTC open interest is down about 3.5% over seven days alongside price, and the Coinbase premium has turned slightly negative, which tells you US spot demand is sitting on its hands into the vote," she said.Bitcoin trading at a discount on Coinbase relative to offshore venues is the clearest expression of that. The premium measures US institutional demand against global flow, and a negative reading means US buyers are paying less rather than bidding up.Liu noted spot Bitcoin ETFs saw around $300 million of net outflows over five sessions before a $160 million inflow Monday. The Market Has Already Adjusted to Life Without the BillFxPro chief market analyst Alex Kuptsikevich made the observation that reframes the stakes.Total crypto market capitalisation sits at $2.65 trillion, roughly where it traded in May — when prediction markets gave the Clarity Act better than a 75% chance of passing this year."It appears the market is getting used to life without this legislation," Kuptsikevich said. The market touched $2.71 trillion Tuesday, matching last week's high, before sliding as Democrats tabled their counterproposal.Siebert Argues the Outcome Matters Less Than Traders AssumeBrian Vieten, senior research analyst at Siebert Financial, offered the dissenting view."We think the market is a bit too focused on whether Clarity passes," he said.A failure would leave US firms operating under the current SEC and CFTC approach, which Vieten said could pull product launches and tokenization work forward into 2027 and 2028 rather than shelving them. That cuts against the conventional reading, in which a failure shelves market structure legislation until after November's midterms.Positioning Is Balanced Into the VoteThe long-short taker-volume ratio in crypto futures remains finely balanced.Cumulative open interest fell 1% to $135 billion over 24 hours while trading volume surged 54% to $207 billion — existing participants closing positions faster than new ones open.Bitcoin's pullback to $77,000 was marked by taker selling in futures, according to Marex, with open interest hovering below 680,000 BTC and signalling weak demand for leveraged exposure.Open interest in ether, Solana and XRP futures also remains in a downtrend. Solana's recently stood at 58.81 million tokens, the lowest since May, per CoinGlass.Funding rates are moderately positive for most major tokens including Bitcoin. Ether and Solana carry mildly negative readings implying a slight short bias — positioning that could fuel a squeeze if cloture clears.Put options have turned marginally pricier than calls. Laevitas noted BTC seven-day 25-delta skew moved from +2.16v to −1.05v, and 30-day from +1.33v to −1.39v, across a calendar covering the Senate vote, Wednesday's Fed decision and Friday's BOJ meeting.Selling Was Near Universal92 of the CoinDesk 100 constituents fell on the day, with the index down 1.6%.Traditional markets moved the other way. Nasdaq 100 futures gained 0.43% and S&P 500 futures 0.35% as some of Monday's AI-driven selloff reversed, while the Dollar Index rose 0.17% — making Tuesday a crypto-specific decline and reversing the pattern of 24 hours earlier.Filecoin's 27% Monday surge, which arrived alongside a 70% jump in futures open interest, unwound at speed. It fell 5.1% since midnight to $0.89 and 13% over 24 hours, with open interest down 23% to $106 million.AI and computing tokens took the brunt for a second session following Anthropic CEO Dario Amodei's weekend call to slow AI development. Internet Computer was worst at 6% lower to $2.58, with Theta down 4.5% and NEAR 3.7%.Uniswap held its bid while the rest of DeFi sold off, adding 1% to $6.60 and 4.8% over 24 hours — a corner of the market with more riding on the vote than most. XRP rose more than 2% to $1.41 and Zcash nearly 3% to about $1,149.Stellar's XLM was the derivatives outlier, up 4% over 24 hours with futures open interest rising more than 10% to 1 billion XLM and annualised funding at 10% — long accumulation without overheating.CoinMarketCap's Altcoin Season index sits at 36/100, neutral after fading last week's surge to 51/100.
