As of Thursday, President Trump had not announced any nominations to fill the vacant commissioner positions. He asserted the agency's "exclusive jurisdiction" over these markets, as companies face legal challenges at the state level related to sports betting laws and insider trading legislation. The CFTC's legal battle over prediction markets continues, with gaming authorities in several states filing lawsuits against companies like Kalshi and Polymarket for allegedly violating state sports betting laws. New Mexico Representative Gabe Vasquez questioned Selig, highlighting the regulatory discrepancies between event contracts and state-level gaming. Vasquez accused the CFTC of exploiting "loopholes" to circumvent state laws, potentially depriving jurisdictions of revenue.
