He expressed his commitment to fulfilling his duties as appointed by U.S. President Donald Trump, despite the scrutiny from lawmakers over his unilateral leadership on rules favoring crypto and prediction markets. As of Thursday, President Trump had not announced any nominations to fill the vacant commissioner positions. During the hearing, Selig reiterated the CFTC's plans to advance rulemaking, particularly concerning event contracts on prediction markets. He asserted the agency's "exclusive jurisdiction" over these markets, as companies face legal challenges at the state level related to sports betting laws and insider trading legislation. The CFTC's legal battle over prediction markets continues, with gaming authorities in several states filing lawsuits against companies like Kalshi and Polymarket for allegedly violating state sports betting laws. New Mexico Representative Gabe Vasquez questioned Selig, highlighting the regulatory discrepancies between event contracts and state-level gaming. Vasquez accused the CFTC of exploiting "loopholes" to circumvent state laws, potentially depriving jurisdictions of revenue. He challenged the agency's role, asking, "Are we regulating real economic risk, or are we allowing prediction markets to steal billions of dollars in an unregulated free-for-all, with no consumer protection as Congress and the CFTC turns a blind eye?" Companies like Kalshi maintain that they fall under the CFTC's sole jurisdiction, a stance that has led to legal victories in states like Arizona and New Jersey, where judges recently blocked state actions against Kalshi.
