Forward Industries, a Solana treasury company, released a digital asset treasury framework in response to SEC Commissioner Hester Peirce's statement on crypto treasuries and lending strategies. According to Foresight News, the framework proposes classifying treasuries into three types based on the actual management authority exercised by operators: Type I, or use, where users choose and set parameters themselves and developers only maintain the code; Type II, or follow, where operators set predefined strategies that users may follow and operators must make co-investments; and Type III, or advisory, where managers exercise actual decision-making power over strategies or specific asset trades and face stricter regulation.
The framework also recommends coordinated SEC and CFTC oversight for treasuries holding both securities and commodities. It further calls for all treasuries to follow basic rules, including related-party transaction disclosures, public code audits, exclusion of disqualified persons, and anti-fraud requirements.
